Many households across India see wives contributing to the family income by offering home tuition to children. It’s a common way to make productive use of spare time while adding a steady stream of earnings. But an important question arises — does this income fall under the income tax net? And if yes, how should it be declared?
To get a clear picture, Moneycontrol spoke to Chartered Accountant and tax expert Suresh Surana, who explained the rules and options available for individuals earning from home tuition.
When Home Tuition Income Becomes TaxableAccording to Surana, the treatment of home tuition income depends largely on the scale of the activity and total earnings in a financial year.
If the tuition is provided on a small scale — meaning there’s no commercial setup or dedicated coaching centre — the earnings can be declared under the head “Income from Other Sources.” However, if the total income (including interest and other sources) exceeds the basic exemption limit prescribed under the Income Tax Act, it becomes mandatory to file an Income Tax Return (ITR).
The current basic exemption limit under the old tax regime is ₹2.5 lakh for individuals below 60 years, ₹3 lakh for senior citizens (60–80 years), and ₹5 lakh for super senior citizens (80 years and above).
Option of Presumptive Taxation Under Section 44ADAFor those whose gross annual receipts from tuition are less than ₹50 lakh, Section 44ADA of the Income Tax Act offers a simpler way to compute tax. Under this presumptive taxation scheme, 50% of the gross receipts are considered as taxable income, and the taxpayer is not required to maintain books of accounts or get them audited.
This option is particularly beneficial for professionals who prefer a hassle-free compliance process. The remaining 50% is deemed to cover expenses, even if the actual expenses are lower.
Declaring Actual Income and Claiming ExpensesIf the taxpayer wishes to declare actual net income after deducting legitimate expenses (such as stationery, internet costs, or part of home rent if used for tuition), they must file ITR-3 under the head “Profits and Gains from Business or Profession.”
In this case, maintaining proper books of accounts under Section 44AA is mandatory, and an audit may be required if turnover exceeds prescribed limits.
Alternatively, if tuition income is declared under “Income from Other Sources”, the taxpayer may file ITR-1 or ITR-2, depending on the overall income structure.
Why Filing ITR Is ImportantThe Income Tax Department actively monitors individuals earning above the exemption limit. Failure to file ITR despite having taxable income may attract notices and potential penalties. Such non-compliance could also create problems in future financial dealings, such as applying for loans or visas.
Surana cautions that even small-scale earners should keep track of their income and comply with tax rules to avoid unnecessary legal complications. Filing ITR on time also serves as a record of income, which can be beneficial for credit applications and government benefits.
