Mumbai: Shariful Fakir, accused of attacking actor Saif Ali Khan, has approached the sessions court for bail. Fakir maintains that the narrative provided by the complainant in the FIR is a fabricated story. Fakir’s lawyer, Advocate Vipul Dushing, filed a bail plea before the sessions court on Friday.
The court has directed the prosecution to submit a reply and scheduled the plea for hearing on Monday. In his plea, Fakir reiterated that there is no evidence or circumstance linking him to the alleged crime. “The investigating agency initially arrested a different person based on the CCTV footage and later conveniently arrested the present applicant using the same footage,” the bail plea states.
It further claims that "all critical evidence, including CCTV footage and call records, is already in the prosecution’s possession. The applicant does not pose any threat of tampering with evidence or influencing witnesses.” Hence, the plea argues that his continued detention is unnecessary.

According to the complaint lodged by a staff nurse at Saif’s residence, Fakir entered the bedroom of Saif’s youngest son, Jehangir, but was stopped by the nurse.
He allegedly attacked her and, when confronted, demanded Rs1 crore. When Saif woke up and intervened, Fakir reportedly attacked him with a knife. Saif underwent emergency surgery at the Lilavati Hospital and was discharged after five days.
Meanwhile, Fakir managed to escape during the scuffle but was arrested on January 19. While seeking bail, Fakir’s lawyers contended that the police failed to provide him with a copy of the grounds of arrest, rendering his arrest illegal. They argued that it is mandatory to provide the grounds of arrest to the accused before taking them into custody
